Abstract
Currently the ownership of about 92 percent of customary land in Minahasa has not been legally registered. As a result, this unregistered customary land has the potential to hinder the socio-economic development process because despite owning it, the owners are not able to use the land to increase the wellbeing and income of the community. This study is conducted to investigate how far the registration of ownership of customary land has an impact towards the development of the Minahasa community, to assess the perception of the community towards the registration of ownership of customary land, and also to identify factors that hinder the process of customary land registration among the Minahasa community. The study adopted the case study approach by using three main data collecting methods. The first method is in-depth interviews which were conducted with respondents that were selected using purposive sampling technique. The second method is a survey using qualitative questionnaire. These two methods are further complemented by non-participant observation conducted by the researcher throughout the study area. The findings of this survey are presented in descriptive statistical manner using percentages and frequencies. On the other hand, the findings from in-depth interviews were analyzed using content analysis. The types of land that are studied are kalakeran land and pasini land.The findings show that customs and a weak land administration system to be the hindering factors in land registration. The Minahasa community faces a lot of difficulties in registering their customary land. This is due to the complicated and stringent customary land rules that made the process of land registration a difficult one. As an example, according to customary rules the ownership of kalakeran land is a joint-ownership and the registration of that particular land must be agreed upon by each of the land owners. If land is registered, the community can easily benefit from the land to increase their living standard. In addition, the findings also show that the Minahasa community has a negative perception towards customary land registration due to the ineffectiveness of the land registration process, despite the fact that this process has many positive impacts towards their socio-economic development.
